Since 16 July 2021, it is against the law to sell products with CE marking without a Responsible Person in the EU. In addition, a Responsible Person must also be specified in accordance with the General Product Safety Regulation (EU) 2023/988.

Right to Repair Instead of Sale

In future, producers will be obliged to repair products even after the statutory warranty period has expired. Vouchers and other financial incentives for repairs are planned. Consumers will have the right to demand that appliances such as washing machines, hoovers, smartphones and bicycles be repaired even after the warranty period has expired. In addition, producers are to provide loaner appliances for the duration of the repair. Independent repair shops are to be strengthened.

BAFA Investigates Violations of the Supply Chain Act

The law firm Noerr reports on the investigation by the Federal Office of Economics and Export Control (BAFA) against 58 German companies for possible violations of the Supply Chain Duties Act (LkSG). From 1 January 2024, companies with more than 1,000 employees must fulfil the requirements of the Supply Chain Act. This also increases the number of companies indirectly affected by the LkSG or SMEs.

Fines for SCIP Reporting

Incorrect or omitted SCIP notifications of articles containing SVHC will be penalised in future: Up to 10,000 euros fine per case. The law came into force on 24 November 2023.
