Since 16 July 2021, it is against the law to sell products with CE marking without a Responsible Person in the EU. In addition, a Responsible Person must also be specified in accordance with the General Product Safety Regulation (EU) 2023/988.

Retailers are required to inspect products before offering them for sale

The German Federal Court of Justice (BGH) has clarified the following in a recent ruling: “Retailers are required to help ensure that only safe consumer products are made available on the market. In particular, they must not make a consumer product available on the market which they know or ought to know, based on the information in their possession or experience, does not comply with the requirements laid down in Section 3.”

Ensuring compliance when offering articles on the market
