Does the SCIP database for substances of concern go too far?

The FDP parliamentary group has submitted a so-called minor enquiry in the German Bundestag as to whether the transmission of information via the SCIP database does not go beyond what is required by law. If you place articles containing SVHCs on the EU market, you should follow this development.

Harmful substances in plastic tableware with bamboo admixture

On 21 May 2021, trade-e-bility reported that products made of bamboo are not suitable for contact with food. On 28 July 2021, the German consumer advice centre (Verbraucherzentrale) likewise reported on harmful substances in plastic tableware with bamboo admixture and recommended caution.

Correct labelling of toys in online shops

Toys belong to the product groups that have to be marked separately in online shops. As online shops want to be easily accessible and easy to find, they are also easily monitored by market surveillance and prone to admonitions.

Use of PFAS chemicals to be restricted

The use of perfluorinated and polyfluorinated alkyl compounds (PFASs) processed in numerous products such as paper, textiles, ski wax, electronic products, wall paints, cleaning agents, pans or cosmetics because of their water, grease and dirt-repellent properties, is to be restricted.

Restrictions on the use of PAHs tightened under REACh

The EU Commission has extended the restrictions on polycyclic aromatic hydrocarbons (PAHs) to include a further 5 applications. These are PAHs used in granulates and mulches for outdoor sports and play applications. Failures to comply can be punished as a criminal offence.

Update of harmonised standards for radio equipment

Effective as of 19 July 2021, the list of harmonised standards for radio equipment (RED) has been extended by implementing decision (EU) 2021/1196. In the EC Declaration of Conformity, these standards may be listed without any further technical justification or reasons.

New regulations for child seats

Since 9 June 2021, new regulations have been in force for approval of child restraint systems in vehicles. The amendments to UN Regulation No. 44 concern the possible configurations available. The first modifications are to be complied with as of 1 September 2021.

Further additives in tobacco products and liquids classified as hazardous

In a publication dated 2 July 2021, the German Federal Institute for Risk Assessment (BfR) has classified further additives in tobacco or liquids as hazardous. These include the additives guar gum and sorbitol. This classification by the BfR means that a ban is to be expected for these additives.

35 per cent of all admonitions are due to incorrect product labelling

As the Händlerbund recently reported, in May of this year more than 35 percent of all admonitions were due to incorrect product labelling. Advertising claims that suggest a use of the product that is not intended by law or that cannot be substantiated are likewise prohibited. Not only may violations be punished by the market surveillance authorities; they can also provide an advantage over market participants who comply with the relevant legislation. If so, then this is the reason for admonitions under the Unfair Competition Act (UWG).
