Battery Declaration of Conformity

For all batteries placed on the market for the first time from 18 August 2024, there is an obligation to draw up an EU Declaration of Conformity and to affix a CE marking.

As take-e-way already reported, producers of individually sold batteries and batteries contained in a product must prove their compliance to Amazon by providing a registration number before 18 August 2025. From this date, Amazon is legally obliged to deactivate your non-compliant offers, depending on the country.

What the Amazon letter does not mention: According to Art. 38 para. 3 of the Batteries Regulation (EU) 2023/1542, all batteries that are placed on the market for the first time from 18 August 2024 are required to have an EU Declaration of Conformity and to bear a CE marking.

In Articles 41 (2) b and 42 (2) b, the EU Batteries Regulation requires importers and sellers to ensure that batteries bear a compliant CE marking before placing them on the market. This applies regardless of whether the battery is installed in a device or sold separately. Your batteries do not fulfil the requirements?
