The Federal Ministry of Food and Agriculture (BMEL) has published a draft law on the implementation of the EU regulation for deforestation-free products (EUDR) on its website. As the DRSC reports, the powers of the authorities and the possible sanctions in the event of violations are regulated. Fines of up to € 100,000 may be imposed for breaches of due diligence obligations and up to € 50,000 for breaches of reporting obligations. For legal entities, the fine is limited to 4% of total annual EU-wide turnover. If violations are suspected, the placing on the market or export of relevant raw materials and products may be prohibited. Under certain conditions, market participants can also be excluded from public financial aid (including concessions) and procurement procedures.
Meanwhile, the European Parliament has published the agenda for the plenary sessions on 13 and 14 November (trade-e-bility reported: EUDR decision in November). On 14 November, there will be a vote on a possible postponement of the start date of the EU regulation on the freedom from deforestation (EUDR), which could possibly give companies more time to prepare. If the deadline is extended, companies are advised to use this time effectively to implement the regulation.
