New registration obligation for packaging in Spain

The Spanish packaging law obliges producers to register their packaging. Distributors from abroad must also register through an authorised representative if they sell packaged products in Spain.

Labelling of power supply units and radio devices

Mobile phones, tablets, digital cameras, headphones, headsets, portable video game consoles, portable speakers, e-readers, keyboards, computer mice, portable navigation systems, earphones, laptops, etc. are affected. Deadline is 28 December 2024.

Our partner IT Recht Kanzlei would like to remind you of the new labelling obligations for power supply units and radio equipment that will be placed on the market from 28.12.2024 (with the exception of laptops). The obligations do not apply to existing and stock goods that were already traded on 28.12.2024. For laptops, the obligations only apply from 28.04.2026 for devices that are newly placed on the market on 28.04.2026.

The new requirements are based on the EU Radio Equipment Directive (RED). For sellers, this means that they must ensure that certain technical devices are correctly labelled and provided with the required information.

Online sellers must also display special symbols on the product detail pages, to indicate whether a power supply unit is included in the scope of delivery, and which charging properties a compatible power supply unit must have. In addition, they must also offer variants without a mains adapter for electrical appliances that are sold with a mains adapter. These regulations apply to all pages from which devices can be added to the shopping basket.

The following products are affected: Mobile phones, tablets, digital cameras, headphones, headsets, portable video game consoles, portable speakers, e-readers, keyboards, computer mice, portable navigation systems, earphones, laptops, etc.

The obligation to provide correct labelling primarily affects online sellers, who must ensure that this information is easily accessible in their product descriptions in the online shop in order to avoid warnings. In extreme cases, failure to comply with online labelling, product range and control obligations can even result in a sales ban being issued by the Federal Network Agency (the responsible supervisory authority) or be punished as an infringement of competition law (Section 3a UWG).
