New registration obligation for packaging in Spain

The Spanish packaging law obliges producers to register their packaging. Distributors from abroad must also register through an authorised representative if they sell packaged products in Spain.

EU Packaging Regulation in force

In order to be able to market packaging and packaged products in the EU in the future in a legally compliant manner, sellers and producers must meet comprehensive requirements.

The Council of the European Union formally adopted the new Regulation (EU) 2025/40 on packaging and packaging waste (EU Packaging Regulation / PPWR) on 16 December 2024. Formal adoption by the Council was the last step in the ordinary legislative procedure. After publication in the EU Official Journal on 22 January 2024, the PPWR entered into force on 11 February 2025. Many of its provisions will not be applied until August 2026, after an 18-month transition period.

The PPWR is one of the most important issues on the to-do list for sellers and producers of products and packaging in the coming months, alongside the EU Batteries Regulation. This is because the PPWR introduces requirements for the entire life cycle of packaging in terms of its environmental sustainability and labelling. In order to be able to market packaging and packaged products in the EU in the future in a legally compliant manner, sellers and producers must meet comprehensive requirements regarding extended producer responsibility (EPR), the avoidance of packaging and packaging waste, reuse and refilling, the labelling of packaging, and the collection and recycling of packaging.
