New registration obligation for packaging in Spain

The Spanish packaging law obliges producers to register their packaging. Distributors from abroad must also register through an authorised representative if they sell packaged products in Spain.

Warning due to missing producer information

Online sellers are obliged to indicate the producing company and its contact details directly on the product or on the packaging. Otherwise there is a risk of a warning letter.

The GPSR Regulation on General Product Safety came into force on 13 December 2024. As trade-e-bility reported (GPSR warning possible), the amendment to the Product Safety Act, which has not yet been adopted, provides for a fine of up to 10,000.00 euros for violations by online sellers in the area of information obligations.

As Onlinehändler News informs, online sellers are already obliged under the current Product Safety Act to indicate the producing company and its contact details directly on the product or (if not otherwise possible) on the packaging. Otherwise, there is a risk of a warning. In one case, the producer's details were neither on the product itself nor on the film bag used for packaging. The required information could also not be found in the offer on eBay.
