The EU Commission reports that it has asked Temu under the Digital Services Act (DSA) to provide information on how the company is preventing the sale of illegal products on its platform and minimising risks to consumer protection, public health and user data. According to Euractiv, Temu must respond by 21 October 2024, detailing the measures taken to reduce the presence and re-emergence of sellers of illegal products on its online marketplace. Based on this information, the Commission will decide on further steps, which could include formal proceedings or fines. Temu was categorised as a "Very Large Online Platform" (VLOP) in May 2024 and must comply with stricter DSA rules.
The TÜV Association also criticises weaknesses in product safety on platforms such as Temu and Shein and calls for consistent application of the Digital Services Act. "In the view of the TÜV Association, the rapid rise of marketplaces such as Temu, Shein and AliExpress highlights the problems with legal enforcement in the area of product safety in the EU internal market."
